These terms apply to our Closed Beta. As we learn and grow alongside our early customers, these terms will evolve.

Welcome to graciously! Before working with us, please read these Terms of Service.

Our View

We'd like to build a reliable, helpful and beautiful system that serves the world.

And the way we see it is that it'd have two major aspects:

  1. The non-human aspect, which includes machine and AI — this is purely our responsibility and we won't bore you with the details of how we are choosing to fulfill that in this document.
  2. The human aspect, which includes those working at graciously, as well as those whom graciously aims to serve. In other words, potentially you, who may be reading this document.

The purpose of this document is to help us align on how we can mutually serve the greater good.

That's how we see what the "Terms of Service" is for.

For those whom this may resonate with and would like to be a part of, that's beautiful. And for those whom this does not, that's alright as well.

In any case, as usual, we hope this is clear and simple to understand. If unclear, do reach out and we always aim to do better.

Who This Is For

We're building something new. The process will be messy—there are many variables, and just like with the world when it comes to AI, we're learning as we go.

Our closed beta is for partners who are open to rough edges, align with our values, and have the risk appetite of innovators and early adopters. If you want a polished, finished product, we're not there yet. If that's you, we'll work closely together to understand your KPIs and meet or exceed them. But this is early, and we're figuring it out together.

What This Agreement Covers

Love Made Visible Inc., operating as graciously ("graciously," "we," "us," or "our"), provides a software-enabled service that helps businesses communicate with their prospects and customers through an AI Sales Agent.

By working with graciously, you agree to these terms.

How We Work Together

Our Role

  • Deeply understand your business, what matters to you, and where you're trying to go
  • Translate that understanding into the inputs that produce ideal outcomes
  • Improve and iterate on those inputs over time
  • Take learnings from this process to build a better system for all

Your Role

  • Communicate clearly about your business and what success looks like
  • Review and approve your AI Sales Agent's capabilities before going live
  • Take responsibility for your AI Sales Agent once it's live, including compliance with applicable laws—especially having prior express written consent (PEWC) from prospects before outreach
  • Maintain your accounts with third-party services we integrate with (like Twilio and GoHighLevel), including their terms and costs
  • Ensure prospects are taken care of afterward

Intellectual Property

Your Content

You retain ownership of your business information, processes, customer data, and any content you provide.

What We Build Together

Configurations we create together are shared. You can use them for your business—even if you leave. We can use them (with your specific details removed) as templates to serve others better.

Pricing

Think of it like sales compensation: you cover the base, we earn the variable.

What You Cover

Infrastructure costs—telephony (Twilio) and AI providers (voice, models)—that power your AI Sales Agent.

Our Compensation

We believe our compensation should reflect the value we create, not just usage. During closed beta, we're exploring what that looks like together. Pricing is case-by-case as we learn.

Data & Privacy

How we handle data is covered in our Privacy Policy. Key points:

  • You own your customer data
  • We use conversation data to deliver and improve our service
  • We will never sell your personal data
  • We're transparent about what we collect and why

Disclaimers

AI Limitations

Your AI Sales Agent may occasionally respond in unexpected ways. Ongoing oversight matters.

No Guarantees

We don't guarantee specific outcomes or business results. Results depend on many factors.

Limitation of Liability

To the maximum extent permitted by law:

  • graciously's total liability is limited to the amounts you've paid us in the 12 months preceding any claim
  • We are not liable for indirect, incidental, or consequential damages
  • We are not liable for actions taken by your AI Sales Agent after you've approved it to go live

Termination

You Can Leave

You may stop using graciously at any time. Contact us to discuss winding down your service.

We Can Part Ways

We may terminate this agreement if:

  • You breach these terms
  • You use the service in ways that harm others
  • Continuing the relationship isn't working for either party

What Happens After

Upon termination:

  • Your AI Sales Agent stops operating
  • You retain your customer data
  • Configurations remain shared (per Intellectual Property)
  • We retain conversation recordings per our Privacy Policy

Governing Law

This agreement is governed by the laws of the State of Delaware, United States.

Changes to These Terms

We may update these terms as our service evolves. When we do:

  • We'll update the "Last Updated" date
  • For significant changes, we'll notify you directly

Continued use after changes constitutes acceptance.
